Learn Dutch with Kim provides online Dutch-language education, including online courses, videos, audio materials, downloadable materials, exercises, quizzes, community activities, live online sessions, and other educational content.

2. Online courses and digital products

Our courses and other digital products are intended for personal, individual use only.

When you purchase a course, you receive apersonal, non-transferable right to access and use the course materials for your own learning.

Unless explicitly stated otherwise, purchasing a course does not transfer ownership or intellectual property rights in any of the materials to you.

Course content may include, among other things:

  • videos and audio recordings;
  • PDFs and other downloadable materials;
  • exercises and quizzes;
  • vocabulary and grammar materials;
  • dialogues and stories;
  • links to external learning tools;
  • AI-powered learning features;
  • community activities; and
  • live or recorded sessions.

The exact content and features vary by course.

3. account and access

You are responsible for keeping your login details secure.

Your account is for your personal use only. You may not share your account, login details, or course access with another person.

We reserve the right to suspend or terminate access if we reasonably believe that an account is being shared, misused, used fraudulently, or used in violation of these Terms.

The duration of access to a course is stated onthe relevant sales or checkout page. Where access is described as lifetime access, this means access for as long as Learn Dutch with Kim continues to offer and support that course or platform, subject to applicable law.

4. prices and payment

Prices are displayed before purchase and may be shown in different currencies.

Any applicable taxes will be handled as indicated during checkout.

Payment may be processed by third-party payment providers or course platforms. Their own terms and privacy policies may also apply to their services.

We reserve the right to change the price of our products at any time. A price change will not affect a purchase that has already been completed.

Discounts, promotional codes, and special offers may have their own conditions and validity periods.

5. right of withdrawal and refunds

Statutory right of withdrawal

If you are a consumer in the European Union or another jurisdiction that provides mandatory consumer rights, you may have a statutory right to withdraw from an online purchase within 14 days without giving a reason.

Where a statutory right of withdrawal applies, you may exercise this right using the online withdrawal function made available through our website or online sales environment. You may also exercise your right of withdrawal by contacting us through the contact details provided on our website or by using any other method permitted by applicable law.

Digital content and immediate access

Where permitted by applicable law, you may be asked during the purchase process to expressly consent to the immediate supply of digital content and to acknowledge that, once the supply of that digital content begins, you lose your statutory right of withdrawal.

Where the legal requirements for the loss of the statutory right of withdrawal have been satisfied, you will no longer have a statutory right to withdraw from the purchase after supply of the digital content has begun.

Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded or restricted.

OUr voluntary 14-day refund policy

Separate from any statutory rights you may have, Learn Dutch with Kim offers a voluntary refund policy for eligible courses and digital products.

Unless otherwise stated on the relevant sales or checkout page, you may request a refund within 14 days of purchase.

Under this voluntary refund policy, you will receive 90% of the purchase price. We retain 10% of the purchase price to cover transaction, platform, and administrative costs.

6. Intellectual property

All course content and materials are owned by Learn Dutch with Kim or used with permission from the relevant rights holder.

This includes, but is not limited to:

  • videos;
  • audio recordings;
  • PDFs;
  • worksheets;
  • exercises;
  • quizzes;
  • lesson texts;
  • dialogues and stories;
  • graphics and illustrations;
  • course structure;
  • branding and logos; and
  • other educational materials.

You may download materials where a download option is provided and use them for your own personal learning.

You may not, without prior written permission:

  • copy or reproduce course materials for commercial purposes;
  • publish or upload them elsewhere;
  • sell, sublicense, or redistribute them;
  • share paid materials with other people;
  • record or redistribute paid live sessions;
  • make course materials publicly available; or
  • use substantial parts of our materials to create or train competing educational products or services.

AI use of course materials

You may use limited excerpts of course materials with AI tools for your own personal, non-commercial learning purposes, for example to request an explanation or translation of an individual sentence or exercise.

You may not, without our prior written permission, upload, provide, reproduce, process or otherwise make substantial parts of our course materials available to an AI system for the purpose of:

  • training, fine-tuning or developing an AI model or AI-powered product;
  • creating or developing a competing course, educational service, AI tutor, chatbot or other commercial product;
  • systematically reproducing, summarising, rewriting or transforming our course materials;
  • generating substantially similar educational or commercial content;
  • creating a database, knowledge base, dataset or similar collection based substantially on our materials; or
  • otherwise commercially exploiting our intellectual property through an AI system.

This restriction applies whether the materials are provided directly to an AI system or used as prompts, examples, reference materials, training data or similar input.

Nothing in this section prevents reasonable personal use of AI tools as part of your own language-learning process, provided that such use does not involve commercial exploitation, redistribution or systematic reproduction of our materials.

7. Community and Live Sessions

Some products may include access to online communities, discussion boards, messaging groups, live classes, conversation sessions, or similar features.

We expect participants to communicate respectfully and not engage in harassment, discrimination, spam, abusive behaviour, or behaviour that significantly disrupts the experience of other participants.

We reserve the right to remove content or restrict or terminate community access in cases of serious or repeated violations.

Access to specific community features or live sessions is not guaranteed indefinitely unless explicitly stated as part of the product purchased.

8. Third-Party Platforms and Services

Our courses and services may use or link to third-party platforms and tools, such as course-hosting platforms, video-conferencing services, flashcard tools, artificial-intelligence tools, payment providers, or community platforms.

We are not responsible for temporary outages, changes, discontinuation, or technical problems caused by third-party services that are outside our reasonable control.

Where reasonably possible, we will try to provide an alternative if a third-party service that forms an important part of a purchased product becomes permanently unavailable.

9. Artificial Intelligence and AI-Powered Features

9.1 use of AI by learn dutch with kim

Learn Dutch with Kim may use artificial-intelligence tools to support the creation, editing and development of educational materials, visual content, administrative processes and other business activities.

AI tools are used as supporting tools. Where appropriate, AI-assisted content is subject to human review before it is incorporated into our courses, services or official communications.

We remain responsible for the products and services that we provide, regardless of whether AI-assisted tools have been used in their creation or operation.

9.2 AI-powered learning features

Certain courses and services may include AI-powered learning features, including interactive language practice, conversational exercises, explanations, feedback and other educational assistance.

Some of these features may allow you to interact with an AI-powered digital representation of Kim (“AI Teacher”). The AI Teacher is an artificial-intelligence system and not Kim personally. Responses from the AI Teacher are generated by AI.

Where required, users will also be informed at the point of interaction that they are communicating with an AI system.

9.3 Accuracy and limitations of AI

Artificial-intelligence systems can generate incorrect, incomplete, outdated or unexpected information.

AI-generated responses and feedback are provided as educational assistance and should not be regarded as guaranteed or authoritative information.

Learn Dutch with Kim does not guarantee the accuracy of every AI-generated response and is not responsible for learning decisions made solely in reliance on an AI-generated response, to the extent permitted by applicable law.

9.4 Information submitted to AI features

Users are responsible for the information they choose to submit when interacting with AI-powered features.

You should not submit sensitive personal information, confidential information, or personal information concerning another person unless this is necessary, appropriate and permitted.

Personal information processed in connection withour AI-powered services is handled in accordance with our Privacy Policy and applicable data-protection law.

9.5 Third-party AI services

Some AI-powered functionality may be provided partly or entirely through third-party technology or services.

Where you choose to create a separate account or purchase a subscription directly from a third-party AI provider, your use of that account or subscription is subject to the terms, conditions and privacy practices of that provider. Unless expressly stated otherwise, Learn Dutch with Kim is not a party to that separate agreement.

We are not responsible for the independent services, decisions or practices of third-party AI providers to the extent that these are outside our reasonable control.

9.6 Changes to AI features

AI technology and third-party AI services may change over time. We may therefore update, replace, modify or discontinue particular AI-powered features where reasonably necessary.

Where an AI-powered feature forms a material part of a purchased product, we will not intentionally remove that functionality without providing an appropriate solution where required by applicable law.

10. Course Updates and Changes

We may occasionally update, improve, replace, reorganise, or remove individual lessons, exercises, links, tools, or features.

We may also update course materials to correcterrors or keep information current.

We will not intentionally make changes that materially deprive you of the core product you purchased without providing an appropriate solution where required by applicable law.

11. Educational results

We aim to provide high-quality Dutch-language education, but learning results vary from person to person.

Purchasing or completing a course does not guarantee a particular language level, examination result, job opportunity, immigration outcome, or other specific result.

Your progress depends on factors including your starting level, study time, practice, and individual learning process.

12. Technical Requirements

You are responsible for having a suitable internet connection, device, browser, software, and other technical requirements necessary to access online course materials.

13. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

We are not responsible for losses caused by circumstances outside our reasonable control, including failures or outages of third-party platforms.

Your personal information is handled in accordance with our Privacy Policy, available on our website.

Third-party platforms used in connection with our services may process personal information under their own privacy policies.

15. Suspension or Termination

We may suspend or terminate access to our services where there is serious or repeated misuse, fraud, unlawful activity, account sharing, infringement of intellectual property rights, or serious violation of these Terms.
