These Affiliate Partnership Terms & Conditions (“Terms”) set out the terms of the affiliate partnership between Dutchies to be – Learn Dutch with Kim (“Dutchies to be”, “we”, “us”) and the participating affiliate (“Affiliate”).

‍By joining or participating in the Dutchies to be Affiliate Program, you agree to these Affiliate Program Terms & Conditions.

1. Affiliate Partnership

The Affiliate may promote eligible Dutchies to be courses and products through its website, blog, social media channels, newsletters, or other agreed promotional channels.

The partnership is non-exclusive. The Affiliate is free to feature or promote other Dutch-learning resources, courses, or services.

The Affiliate may not present itself as an employee, representative, or official agent of Dutchies to be.

2. Affiliate Commission

The Affiliate receives a 20% commission on eligible purchases that are successfully attributed to the Affiliate through their unique Teachable affiliate link.

Affiliate sales and commissions are tracked through Teachable’s affiliate tracking system.

Commission is only earned when a purchase is successfully attributed to the Affiliate through their Teachable affiliate link. The Affiliate is responsible for ensuring that the correct affiliate link is used when referring customers.

Purchases that are not tracked and attributed to the Affiliate by Teachable are not eligible for Affiliate commission. The use of an Affiliate’s discount code without the Affiliate referral being successfully tracked by Teachable does not, by itself, create an entitlement to commission.

UTM parameters may be added to Affiliate links for analytics purposes, provided that they do not interfere with Teachable’s affiliate tracking.

Commission is calculated on the eligible transaction amount as recorded by Teachable, excluding applicable taxes, refunds, chargebacks, and other amounts excluded by Teachable from the commission calculation.

3. Customer Discount

Customers referred by the Affiliate may receive a 10% discount through the Affiliate’s unique discount code.

At the start of the partnership, the Affiliate may choose a unique discount code, subject to approval by Dutchies to be. Once the discount code has been created and approved, it is intended to remain the Affiliate’s permanent discount code and cannot be changed on a recurring or regular basis. Any later change to the discount code is at the sole discretion of Dutchies to be.

The Affiliate discount cannot be combined with temporary promotions, sales, or other promotional discounts offered by Dutchies to be, including promotions such as Black Friday sales, unless Dutchies to be explicitly states otherwise.

Discount codes are intended for genuine referrals from the Affiliate and may not be published on coupon, voucher, or discount-code websites without prior written permission.

Dutchies to be may exclude specific products, bundles, promotions, subscriptions, or other offers from the standard Affiliate discount or commission structure.

4. Tracking and Attribution

Affiliate referrals, sales, and commissions are tracked through Teachable.

Each Affiliate receives a unique Affiliate link containing their Affiliate tracking code. Affiliates must use this link when referring potential customers in order for the referral to be eligible for commission.

Teachable uses cookies and other attribution mechanisms to associate eligible purchases with Affiliate referrals. The applicable attribution window is determined by Dutchies to be within the settings provided by Teachable.

If more than one Affiliate refers the same customer, attribution will be determined by Teachable according to the attribution rules in effect on the platform at the time of purchase.

Dutchies to be is not responsible for untracked referrals resulting from, for example, an Affiliate link not being used correctly, cookies being deleted or blocked, the customer using a different device or browser, or other circumstances that prevent Teachable from attributing the transaction to the Affiliate.

Teachable’s tracking records will be used as the basis for determining Affiliate commissions.

5. Commission Payments

Affiliate commissions are tracked through Teachable.

Where Dutchies to be uses Teachable’s automated Affiliate payout service, Affiliate payments will be processed by Teachable according to Teachable’s applicable payout schedule and requirements.

Affiliates are responsible for completing any payout information required by Teachable. Where PayPal is used for Affiliate payouts, the Affiliate must provide and maintain a valid PayPal account in their Teachable Affiliate Dashboard in order to receive payment.

Under Teachable’s current legacy automated payout system, eligible Affiliate earnings are generally subject to an initial 30-day holding period and are paid on the first business day of the applicable payout month. Teachable’s payout systems and schedules may change over time, and the payout rules applicable within Teachable at the time of payment will apply.

If an order is refunded, cancelled, charged back, or otherwise reversed, any related Affiliate commission will also be cancelled, reversed, or deducted from future Affiliate earnings where applicable.

6. Promotion and Brand Use

The Affiliate is welcome to promote Dutchies to be in its own voice and style, provided that all information shared about our courses, pricing, discounts, and services is accurate.

The Affiliate may use promotional materials, course images, logos, and other brand assets supplied or approved by Dutchies to be for the purpose of promoting the Affiliate partnership.

The Affiliate may not:

  • make false, misleading, or unsubstantiated claims about Dutchies to be or its courses;
  • modify Dutchies to be branding in a misleading way;
  • suggest that Dutchies to be endorses the Affiliate or its other products or services unless this has been expressly agreed;
  • run paid advertising using the “Dutchies to be” or “Learn Dutch with Kim” brand names or closely related search terms without prior written permission;
  • engage in spam, misleading advertising, cookie stuffing, self-referrals, or other methods intended to manipulate Affiliate tracking.

7. Other Dutch-Learning Products

This Affiliate partnership is non-exclusive.

The Affiliate may feature or promote other Dutch courses, language-learning platforms, or educational resources.

However, the Affiliate agrees not to make false or misleading comparisons involving Dutchies to be or imply that Dutchies to be has approved, endorsed, or partnered with another provider unless this has been explicitly agreed in writing.

8. Course Information and Pricing

Dutchies to be may change its course offerings, prices, discounts, bundles, or other commercial terms from time to time.

The Affiliate is responsible for keeping information published on its own channels reasonably up to date.

9. Termination

Either party may end the Affiliate partnership at any time.

Dutchies to be may immediately suspend or terminate an Affiliate account in cases of fraud, misleading promotion, misuse of discount codes or tracking links, violation of these terms, or conduct that could reasonably harm the Dutchies to be brand.

Valid commissions earned before termination will remain payable, provided that the underlying transactions remain eligible under this Agreement and are recorded as Affiliate transactions by Teachable.

10. Changes to These Terms

Dutchies to be may update these Affiliate terms when reasonably necessary, for example due to changes in the Affiliate program, course offerings, pricing, payment systems, Teachable’s Affiliate functionality, or applicable requirements.

11. Independent Relationship

The Affiliate participates as an independent partner. Nothing in this Agreement creates an employment relationship, agency, joint venture, or other legal partnership between the Affiliate and Dutchies to be.

The Affiliate is responsible for any taxes, reporting obligations, or other requirements applicable to Affiliate income in their own jurisdiction.
